The (NSW) Occupational Health and Safety Amendment (Long Distance Truck Driver Fatigue) Regulation 2005

 
   
  The Regulation was gazetted on 10 June 2005 for commencement on 1 March 2006. The object of this Regulation is to reduce the likelihood of injury or illness arising from the fatigue of the drivers of heavy trucks. In order to do this, this Regulation places a number of specific obligations on:
  • Head Carriers (including their agents and persons acting on their behalf);
  • Employers; and
  • Consignors and Consignees with 200 or more employees (or their agents and persons acting on their behalf)

if these parties contract with a self-employed carrier and/or direct an employee to transport freight 500 kilometres or more by means of a heavy truck (being that with a GVM of 4.5 tonnes or more) in a number of situations.

The ATA has produced three documents to assist parties meet their obligations under this Regulation, being:

(1) GUIDELINES FOR HEAD CARRIERS and EMPLOYERS TO ASSIST IN COMPLYING WITH THE (NSW) OCCUPATIONAL HEALTH AND SAFETY AMENDMENT (LONG DISTANCE TRUCK DRIVER FATIGUE) REGULATION 2005

(2) UNDERSTANDING FATIGUE - INFORMATION FOR HEAD CARRIERS and EMPLOYERS TO ASSIST IN COMPLYING WITH THE (NSW) OCCUPATIONAL HEALTH AND SAFETY AMENDMENT (LONG DISTANCE TRUCK DRIVER FATIGUE) REGULATION 2005

(3) ADDRESSING COMMON FATIGUE RISKS - ASSISTANCE FOR HEAD CARRIERS and EMPLOYERS TO ASSIST IN COMPLYING WITH THE
